“Clare is an excellent litigator and go-to choice for claimant matters.”

“She was stellar.” Chambers UK 2025

Clare Brereton specialises in high stakes disputes and strategic workplace advice for senior executives and employers alike.

Her practice focuses on complex matters focussing on whistleblowing, stress at work, permanent health insurance, disability discrimination alongside the full spectrum of employment issues. Clare is particularly noted for her expertise in cases with a mental health element, where she combines rigorous legal analysis with outstanding client care and emotional intelligence.

Praised by The Legal 500 UK for her “outstanding client management skills, and serious litigation nous,” Clare is a formidable advocate in the Employment Tribunal, Employment Appeal Tribunal and High Court. She has advised clients in Employment Tribunal claims for ordinary unfair dismissal, automatic unfair dismissal due to whistleblowing, whistleblowing detriment, race discrimination, disability discrimination, harassment and victimisation. She has also represented clients in High Court claims for breach of contract and personal injury. Notably, Clare played a key role acting as part of the team for Tony Danker in his dispute with the CBI. The former director-general brought legal action against the CBI over its handling of his dismissal following complaints about workplace misconduct. The case was reported extensively on numerous media channels, including being lead story on the BBC.

“Super-supportive” Clare is ranked as a Next Generation Partner for Employment: Senior Executives in The Legal 500 UK 2026. She is described as “very thoughtful but pragmatic and direct.” She is also ranked for Employment: Senior Executive in Chambers UK 2026, with the publication stating, “She is always consistent and responsive.”

Previous editions say that Clare “embodies the approach of the firm – she has outstanding client management skills and is a heavyweight litigator.” She is described as “superb; she is incredibly calm in a crisis to get a client out of a hole and is a master tactician.”

Clare represents both claimants and employers across a wide range of issues, including:

  • Whistleblowing claims (detriment and automatic unfair dismissal claims following making protected disclosures)
  • Discrimination, harassment and victimisation, with a particular focus on disability discrimination
  • Stress at work and permanent health insurance disputes
  • High value unfair dismissal and breach of contract claims
  • Performance, disciplinary, grievance and redundancy processes
  • Negotiated exits and severance arrangements
  • Enforcement of post-termination restrictions

She brings fresh perspective alongside her established strengths in achieving pragmatic, commercial outcomes, whether through negotiated settlements or robust litigation. Clare continues to handle significant ongoing matters and is particularly valued for her calm, tactical approach in challenging and sensitive litigation.

Clare is an active member of the Employment Lawyers Association (ELA) and sits on its Pro Bono Committee.

Clare enjoys running, yoga, travelling and following speedway (she proudly supported the Workington Comets during their treble-winning season and was at the National Speedway Stadium when Great Britain won the Speedway of Nations in 2021). As a working parent to her young son, she brings additional insight and empathy to issues affecting work-life balance and return-to-work transitions.
