Obtaining a financial settlement and internal transfer for a disabled employee
Our client was Legal Counsel within a multinational bank. Their line manager raised unsubstantiated performance concerns which stemmed from our client’s disability. Following a lack of support from their manager and their poorest performance rating in over 10 years, they received a lower bonus award, was subjected to comments about their disability which amounted to harassment and a refusal by their line manager to implement the adjustments recommended by Occupational Health. We supported our client through their grievance process and, as a result of the issues raised, they were offered an internal transfer to a different department. Alongside this, we negotiated a settlement of their Employment Tribunal claims prior to receipt of the Bank’s defence. Our client received a payment for injury to feelings and compensation for the reduced bonus awarded and remained in employment with the Bank.
